The author examines in detail the concept of the general composition of fraud and methods of committing it in the housing sector. Along with this, innovations in the criminal law are analyzed regarding liability for special types of fraud, including fraud that resulted in the deprivation of a citizen’s rights to residential property. The problems of qualifying fraudulent actions in the purchase and sale of residential real estate, rental of residential premises, shared participation in housing construction and other illegal actions in the housing sector are considered. The issues are examined taking into account the historical positions of the legislation of foreign countries, doctrinal concepts and judicial interpretation.
